Website Design Service
Terms for website creation services provided to Washa partners At Washa, we create websites specifically for car wash, car valeting and detailing businesses. These terms explain how our Website Design Service works and help make the process clear for both Washa and our partners.
1. Website creation
Washa can create a website in different ways, depending on what is agreed with the partner.
A website may be designed by Washa; designed based on a direction agreed together with the partner; or developed based on a design, reference or layout provided by the partner.
Washa takes into account the partner’s brand identity, preferred colours and reasonable design preferences. This does not mean that Washa must accept or implement every possible request.
The final design, functionality and requirements remain subject to the individually agreed project scope.
To create the website, the partner may provide Washa with materials and business information including, but not limited to:
- business name
- logo and brand materials
- photographs and images
- business address and contact details
- services and prices
- opening hours
- descriptions and other information related to the partner’s business
By providing these materials, the Partner confirms that they have the right to use them and authorizes Washa to use, reproduce and display them as necessary to design, publish, operate and maintain the Partner’s website.
2. Project scope, price and timeline
Every business and website is different.
The final project scope, website price, payment terms and expected delivery timeline are agreed individually with each partner.
The final price may depend on the website structure, required functionality, integrations, amount of content, languages, customization and other project requirements.
3. Payment and confirmation of the project
Payment or an agreed prepayment confirms the partner’s intention to proceed with the Website Design Service and allows Washa to begin allocating resources and working on the project.
Once the project has started following payment or prepayment, amounts paid for the Website Design Service are non-refundable, except where otherwise required by applicable law or explicitly agreed with Washa in writing.
Any additional work outside the originally agreed project scope may be quoted and charged separately.
4. Partner cooperation
The partner is responsible for providing the information, materials, access and feedback reasonably required to complete the website.
Project timelines may depend on how quickly the necessary materials, information and approvals are provided.
Delays caused by missing information, materials, approvals or responses from the partner may result in a corresponding change to the expected delivery date.
5. Third-party services
A website may depend on services and infrastructure provided by third parties, including domain registrars, DNS providers, hosting infrastructure, search engines, payment providers, messaging platforms, maps, analytics services, social networks and other external services.
Washa cannot guarantee the continuous availability, functionality or behaviour of third-party services and is not responsible for interruptions, restrictions, policy changes, technical problems or other circumstances caused by services outside Washa’s control.
Where third-party services require separate accounts, subscriptions, licences or payments, these may remain the responsibility of the partner unless otherwise agreed.
6. Washa CRM integration
Certain website functionality is directly connected to Washa CRM and requires an active Washa CRM subscription.
Online Booking is available as an interactive booking system while the partner has the required active Washa CRM subscription.
If the required Washa CRM subscription is no longer active, the relevant services and prices may remain visible on the website as a price list, but customers will no longer be able to create bookings through the Washa Online Booking system.
Links or integrations with the partner’s Washa Client App are also available only while the relevant Washa subscription and Client App service remain active.
Other functionality that depends on Washa services may similarly require an active subscription.
7. Partner Ownership
Everything originally belonging to or provided by the Partner remains the Partner’s property, including:
- company/business name
- brand
- logo
- trademark
- colours
- photographs and images
- marketing materials
- original text and content
- business information
Washa does not claim ownership of the Partner’s brand or content.
Washa’s use of Partner materials to design, publish, operate and maintain the website does not transfer ownership of those materials to Washa.
8. Intellectual Property
The following remain the exclusive intellectual property of Washa:
- source code developed or owned by Washa
- Washa CRM
- APIs and integrations
- Online Booking technology
- reusable website components
- templates
- libraries
- platform architecture
- internal tools and technical solutions
- infrastructure and other Washa technology
Creating a website for a Partner does not transfer ownership of Washa technology or intellectual property to the Partner unless explicitly agreed otherwise in writing.
Partner ownership of Partner content does not give the Partner ownership of Washa technology.
9. Powered by Washa
Websites created through the Washa Website Design Service include a small attribution in the website footer:
Powered by Washa
Washa must link to: https://business.appwasha.com/
This attribution is part of the Website Design Service and remains visible on websites created by Washa unless otherwise explicitly agreed in writing.
10. Search engines, SEO and external discovery
Washa may structure and optimize the website to improve its technical foundation for search engines, local search and AI-based discovery services.
However, search engines, AI services and other external platforms determine their own rankings and recommendations.
Washa therefore cannot guarantee any particular Google ranking, search position, amount of website traffic, number of leads or customers, or inclusion or recommendation by services such as Google, ChatGPT, Gemini or other third-party platforms.
11. Changes and additional work
Reasonable adjustments included in the agreed project scope can be discussed during website creation.
New pages, substantial redesigns, additional functionality, integrations or other requirements outside the agreed scope may be treated as additional work and may require a separate quotation.
After the website has been completed, future changes or development may also be quoted separately unless they are covered by another agreement or Washa service.
12. Portfolio
Unless explicitly requested otherwise in writing, Washa may list a website created through the Website Design Service as part of its portfolio and reference it as a completed Website Design project.
This may include displaying the Partner’s business name, logo, website URL and screenshots or publicly available views of the website on Washa websites, presentations, demonstrations and marketing materials.
No confidential information may be disclosed.
This permission does not transfer ownership of the Partner’s brand or content to Washa.

These Terms become effective immediately upon payment or prepayment.
Nothing in these Terms shall be interpreted as a transfer or sale of Washa’s intellectual property unless explicitly agreed in writing.
